Privacy Policy

Arete Leadership Consulting, LLC (“Arete”) has set up this Privacy Policy (the “Privacy Policy”

or “Policy”) to explain to you how your information is protected, collected, and used. Arete may

update this Policy at any time. Arete will provide notice of materially significant changes to this

Privacy Policy by posting notice on the Arete website located at https://www.arete-leader.com

(the “Site”). This Privacy Policy applies to individuals who visit the Site, submit inquiries, or

otherwise interact with Arete prior to entering into a formal coaching agreement. If you become a

client, your information will also be governed by the terms of your separate coaching agreement.

By using the Site, you agree to all terms in this Privacy Policy, which is incorporated herein by

reference.

Protecting Your Privacy

Arete uses commercially reasonable administrative, technical, and physical safeguards to protect

your personal information. Arete will not share your personal information with third parties for

marketing purposes without your prior consent except as stated in this Privacy Policy.

Arete, or people who post on the Site, may provide links to third-party websites, which may have

different privacy practices. Arete is not responsible for, and does not have any control over, the

privacy policies of those third-party websites, and encourages all users to read the privacy

policies of each website visited.

The Site is intended for individuals over the age of 18. To become a client of Arete, you must

contact Arete and sign an engagement agreement with Arete. Use of the Site does not make you a

client. The Site is for informational purposes only.

The services provided by Arete are for personal development and coaching purposes only. Arete

does not provide medical, psychological, or mental health services, and information submitted

through the Site is not considered protected health information under the Health Insurance

Portability and Accountability Act (HIPAA). Users should not submit sensitive medical or mental

health information through the Site.

Use of the Site by Minors

Arete does not knowingly collect any information from persons under the age of 18 years of age.

Data Arete Collects

Arete may collect the following data:

  • name.

  • email address.

  • physical contact information, including physical address and phone number.

  • payment information is processed by third-party payment processors, and Arete does

    not store full credit card numbers on its systems.

  • information that you enter into the Site.

  • billing and other information you provide to buy a service from Arete if you become

    a client of Arete.

  • dispute resolution, correspondence through the Site and/or correspondence sent to

    Arete by any other means (such as mail, email, contact forms online, telephone

    messages, etc.).

  • other supplemental information from third parties (for example, if there is a problem

    charging your credit card, Arete may receive information from the credit card

    company or Arete may request information from third parties with permission).

Arete processes personal information for legitimate business purposes, including providing

services, responding to inquiries, complying with legal obligations, and improving the Site.

Arete sometimes collects your email address, for purposes such as sending confirmation emails,

sending information about products and specials, and sending information about services that you

have purchased. By giving your email to Arete, you consent to emails from Arete. For all

marketing emails, you will have the opportunity to opt-out as required by law.

Arete sometimes collects your phone number. If you submit your phone number to Arete, you

consent to being contacted by phone or text regarding your inquiry or services, as permitted by

applicable law.

Arete is not responsible for any misuse of information by a third-party.

Arete may collect personal information if you provide it in feedback or comments or if you

contact Arete directly. Information submitted through public areas of the Site is not treated as

confidential. While Arete takes reasonable steps to protect information submitted through private

forms or communications, the Site is not intended for the transmission of highly sensitive or

confidential information. Please do not post anything on the Site that you would like to keep

private.

Arete’s web logs collect standard web log entries for each page served, including your IP address,

page URL, and timestamp. Web logs help Arete diagnose problems with our server, to administer

the Site, and to otherwise provide Arete’s service to you. In addition, Arete may collect other

information from your interaction with the Site, content, and advertising, including computer and

connection information, statistics on page views, traffic to and from the Site, advertising data, IP

address, demographic and navigational data, and standard web log information. Arete may obtain

this information from a third-party provider. Arete may use this information for the purposes

described in this Privacy Policy, including to operate the Site, provide services, communicate

with users, comply with legal obligations, and support business operations.

Arete may use your information to:

  • respond to inquiries and provide requested information

  • deliver coaching services (if applicable)

  • process payments

  • send administrative communications

  • send marketing communications (subject to opt-out rights)

  • improve the Site and user experience

The Site does not currently respond to Do Not Track signals.

Data Arete Stores

Arete may retain certain information as necessary to comply with legal obligations, resolve

disputes, and enforce agreements, even after a user requests deletion. In addition, Arete may

archive this information elsewhere as well.

Web logs and other records are retained only as long as reasonably necessary for business or legal

purposes. This may include information about the products and services you bought and your

browsing history.

Although Arete makes good-faith efforts to store the information in a secure operating

environment that is not available to the public, Arete cannot guarantee complete security.

Arete may store information in an off-site location, which may or may not be in the United States

and may not be bound by the laws of the United States.

Archiving and display of Arete’s web pages by search engines and other sites

Search engines and other sites not affiliated with Arete - including Google.com, Bing.com and

Yahoo.com - archive or otherwise make available Arete’s web pages. Arete has no control over

third-party archiving and search engine sites and cannot guarantee the accuracy of any

information stored by search engine sites.

Depending on your jurisdiction, you may have the right to:

  • request access to your personal information

  • request correction or deletion

  • opt out of marketing communications

  • request information about how your data is used

In addition to the above, Colorado residents may have additional rights under the Colorado

Privacy Act, including the right to appeal a denial of a request to exercise their rights. To submit a

Circumstances in which Arete May Release Information

Arete may disclose information about its users if required to do so by law or in the good-faith

belief that such disclosure is necessary to respond to subpoenas, court orders, or other legal

process.

Arete may disclose information about its users to law enforcement officers or others, in the good-

faith belief that such disclosure is reasonably necessary to: enforce our Terms of Use; respond to

claims that any posting or other content violates the rights of third parties; or protect the rights,

property, or personal safety of Arete, its users, or the general public.

Arete may disclose information about payment information if there is a dispute over payments

made to Arete.

Arete may disclose your information to third parties for use by Arete. This may include disclosure

to email marketing providers to provide targeted marketing for our users. If you do not wish to

receive email marketing from Arete, you will have the choice to unsubscribe from the service.

Arete may disclose your information to other business entities if a business entity plans to merge

with Arete or buy Arete.

If you become a client of Arete, additional reasons that Arete may disclose your information may

be agreed to via separate agreement between you and Arete.

Arete may share information with third-party service providers that assist in operating the Site

and providing services (such as hosting providers, email platforms, and payment processors),

subject to appropriate confidentiality obligations.

International Users

Arete’s services are only available to users located in the United States at this time. By using the

Site, you are representing to Arete that you are located in the United States.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the

visitor’s browser provides to the website each time the visitor returns. We use cookies to help us

identify and track visitors, their usage of our websites, and their website access preferences. Users

who do not wish to have cookies placed on their computers should set their browsers to refuse

cookies before using the Site, with the drawback that certain features of the Site may not function

properly without the aid of cookies. Cookies may be used for analytics, functionality, and

marketing purposes.

Client Agreement

If you become a client, your information will also be governed by a separate written coaching

agreement. In the event of a conflict between this Privacy Policy and the coaching agreement, the

coaching agreement will control.
